These Terms of Service ("Terms") govern your access to and use of Fanchaty.ai (the "Platform" or "Site"), operated by Fanchaty AI LTD ("Company," "we," "us," or "our").
By accessing or using Fanchaty.ai, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
1. Description of Service
Fanchaty.ai is a digital platform that utilizes artificial intelligence (AI) models to create virtual characters that converse with users. The services provided include:
AI-powered chat,
Generation of images, text, and audio,
User-customizable characters,
Free and paid subscription tiers,
Token-based additional features.
All conversations, responses, and characters generated on the Platform are entirely fictional.
2. Purpose and Limitations
Fanchaty.ai is intended strictly for entertainment purposes.
The Platform does not provide professional psychological, medical, legal, or financial advice.
AI-generated content may not always be accurate, complete, or reliable.
The user acknowledges that any consequences arising from the use of generated content are entirely their own responsibility.
No AI character represents a real person.
3. Account Registration and Security
Accessing certain parts of the Platform may require you to create an account. You agree that:
You will provide accurate and up-to-date information.
You are solely responsible for maintaining the security of your account credentials.
You will not sell, transfer, or share your account with third parties.
You will update your account information if any changes occur.
The Company reserves the right to suspend or permanently terminate your account if suspicious or inappropriate usage is detected.
4. Subscriptions, Billing, and Tokens
While Fanchaty.ai may offer free features, premium features require a paid subscription.
Subscriptions may be billed on a monthly, quarterly, or semi-annual basis.
Payments are processed via credit card, debit card, or other accepted payment methods.
Subscriptions renew automatically at the end of each billing cycle.
You may turn off auto-renewal at any time through your account settings.
Token or limit packages must be used within their respective billing period; they do not roll over to the next period and cannot be transferred to other accounts.
5. Cancellation and Refund Policy
5.1 Subscription Cancellation
You may cancel your subscription at any time. Upon cancellation:
You will retain access to premium features until the end of your current billing cycle.
You will not be charged for the subsequent cycle.
5.2 Refund Conditions and EU Right of Withdrawal Waiver
EU Consumer Notice: By purchasing a subscription or tokens, you expressly consent to the immediate performance of the digital service and acknowledge that you will lose your 14-day right of withdrawal under EU consumer law once the digital content has been partially or fully provided.
Refunds may be requested within 24 hours of payment.
No refunds will be issued if the user has consumed 5 tokens, sent 20 messages, or exceeded this usage threshold.
No refunds will be issued for technical issues caused by the user's side.
Refunds are only available for payments made via credit/debit cards.
6. User Content and Licensing
You retain ownership of the data, text, prompts, and content you provide to the Platform ("User Content"). However, to operate the Service, you grant the Company a non-revocable, transferable, worldwide, and royalty-free license to:
Process the content,
Train and develop AI models,
Review the content for security and moderation purposes,
Use the content in an anonymized manner to improve the service.
7. Prohibited Conduct
Users are strictly prohibited from engaging in the following activities:
Requesting or sharing illegal content.
Harassment, threats, violence, or hate speech.
Child exploitation or Child Sexual Abuse Material (CSAM).
Doxing or sharing private personal data (addresses, phone numbers, financial info, etc.).
Hacking, manipulating, or reverse-engineering the Platform.
Buying/selling accounts or trading tokens.
Abusing the platform via bots or automated tools.
Overloading, attacking, or causing technical disruption to the infrastructure.
Engaging in these behaviors will result in immediate and permanent account termination.
8. Content Moderation
To ensure safety, Fanchaty.ai utilizes:
Automated moderation systems,
Manual review when deemed necessary.
Content that violates our rules may be deleted, and the responsible account may be terminated. No refunds will be issued for accounts terminated due to moderation actions.
9. Intellectual Property Rights
All rights, title, and interest in the Platform, including:
Software, design, interfaces, and logos,
AI-generated imagery and assets provided by the platform,
Platform infrastructure, are the exclusive property of Fanchaty AI LTD. Users may not copy, distribute, sell, or reverse-engineer any part of the Platform.
10. Third-Party Services
The Platform may utilize third-party services, including payment processors, messaging services, and AI APIs. The Company cannot be held liable for any interruptions, errors, or malfunctions arising from these third-party services.
11. Disclaimer of Warranties
Fanchaty.ai is provided on an "AS IS" and "AS AVAILABLE" basis. The Company makes no warranties or representations that:
The Platform will function without errors or interruptions.
AI outputs will be strictly accurate or reliable.
The Service will fully meet the user's expectations or requirements.
All bugs or errors will be corrected. The user bears full responsibility for all outcomes of using the service.
12. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for:
Loss of profits or revenue,
Loss of data,
Indirect, incidental, or consequential damages,
Misinterpretation or misuse of AI outputs,
Third-party service failures.
13. Termination and Suspension
The Company may terminate or suspend your account under the following circumstances:
Violation of these Terms,
Suspicious activity or fraud (including chargebacks),
Behavior that harms the Platform or other users. The Company reserves the right to terminate access entirely at its sole discretion.
14. Governing Law and Jurisdiction These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Modifications to the Terms
The Company reserves the right to update or modify these Terms at any time. Updates become effective immediately upon being published on the Platform. Continued use of the Service constitutes your acceptance of the revised Terms.
16. Termination by User
You may terminate this agreement at any time by closing your account and ceasing all use of the Platform.
